The K-3 visa is a visa category that allows the spouse of a U.S. citizen to enter the United States while they await the approval of their immigrant visa petition. Here are some details about the K-3 visa:
1. Purpose: The K-3 visa was created to reduce the physical separation between U.S. citizens and their foreign spouses during the lengthy immigrant visa process.
2. Eligibility: To be eligible for a K-3 visa, you must be legally married to a U.S. citizen. The U.S. citizen spouse must file an immigrant visa petition (Form I-130) on your behalf with the U.S. Citizenship and Immigration Services (USCIS).
3. Application Process: After the I-130 petition is filed, the U.S. citizen spouse can then file a K-3 visa petition (Form I-129F) for the foreign spouse. Once the petition is approved, it will be forwarded to the U.S. embassy or consulate in the foreign spouse’s home country.
