EB-2 Visa


If you have an advanced degree or exceptional ability in the sciences, arts, or business, you might qualify for an employment-based, second preference visa. Here are the different categories and requirements for this visa:

You must have a job offer that requires an advanced degree, and you must have that degree or its foreign equivalent (a bachelor’s degree or its foreign equivalent plus 5 years of progressive work experience in the field). You must also meet any other requirements listed on the labor certification as of the priority date.

You must provide documents such as an official transcript showing that you have a U.S. advanced degree or a foreign equivalent degree, or an official transcript showing that you have a U.S. bachelor’s degree or a foreign equivalent degree and letters from current or former employers showing that you have at least 5 years of progressive work experience in the field.

If the job normally requires a doctoral degree, you must have a U.S. doctorate or a foreign equivalent degree.

Exceptional Ability

You must demonstrate exceptional ability in the sciences, arts, or business. Exceptional ability means that you have a level of expertise significantly above the ordinary in the sciences, arts, or business. You must also meet any requirements listed on the labor certification as applicable.

You must also fulfil three of the following criteria;

· Official academic record showing that you have a degree, diploma, certificate, or similar award from a college, university, school, or other institution of learning relating to your area of exceptional ability.

· Letters from current or former employers documenting at least 10 years of full-time experience in your occupation.

· A license to practice your profession or certification for your profession or occupation.

· Evidence that you have commanded a salary or other remuneration for services that demonstrates your exceptional ability.

· Membership in a professional association(s)

· Recognition for your achievements and significant contributions to your industry or field by your peers, government entities, professional or business organizations

· Other comparable evidence of eligibility is also acceptable
